The offer and sale of products made on the website www.henryandhenryshop.com are governed by these General Conditions of Sale. Before sending the purchase order, the Customer must carefully read these general conditions of sale. The forwarding of the purchase order implies the full knowledge and express acceptance of both the aforementioned general conditions of sale and of what indicated in the Order Form. Once the online purchase procedure is concluded, the Customer is obliged to print and keep these general sales conditions and the related order form, already viewed and accepted.
1. Object
1.1 These General Conditions of Sale have as their object the sale of products made online through e-commerce service on the site www.henryandhenryshop.com.
1.2 The products sold on the site can be purchased and delivered exclusively in the countries indicated in the Order Form. Any orders for shipments to be made outside these countries will be automatically rejected during the order processing procedure.

2.2 These General Conditions of Sale govern the offer, forwarding and acceptance of purchase orders for products on www.henryandhhenryshop.com and do not regulate, however, the provision of services or the sale of products by subjects other than the Seller that are present on www.henryandhenryshop.com through links, banners or other hypertext links. Before sending orders and purchasing products and services from parties other than the Seller, we suggest checking their terms of sale, because the Seller is not responsible for the provision of services by third parties other than the Seller.
2.3 The products are sold to the Customer identified by the data entered when completing and sending the order form in electronic format with simultaneous acceptance of these General Conditions of Sale.

2.6 Accepting these Conditions of Sale, moreover, you exonerate the Seller from any responsibility deriving from the issue of incorrect tax documents due to errors in the data provided by you when placing the online order, being yourself as a customer the only responsible for their correct insertion.
3. The sale via e-commerce service
3.1 An online sales contract refers to the distance contract concerning the sale of movable goods (hereinafter Products) stipulated between you, as a Customer, and Randi Creazioni Srl, as Seller, as part of a service of electronic commerce organized by the Vendor which, for this purpose, uses the remote communication technology known as the Internet.
3.2 To conclude the purchase contract of one or more Products, you will have to fill in the order form in electronic format (hereinafter Order) and transmit it to the Seller through the Internet by following the relative instructions.
3.3 The Order contains:
- a reference to these General Conditions of Sale;
- informations and images of each Product and its price;
- the methods of payment that you can use;
- the methods of delivery of the Products purchased and the relative shipping and delivery costs;
- a reference to the conditions for exercising your right of withdrawal;
- the methods and times for returning the purchased products.
3.4 Despite Randi Creazioni S.r.l. constantly adopts measures to ensure that the photographs shown on the Site are faithful reproductions of the original products, including the adoption of every possible technological solution to minimize inaccuracies, some variations are always possible due to the technical characteristics and characteristics of resolution of the colors of the computer you use. As a consequence, the Seller will not be responsible for the possible inadequacy of the graphic representations of products shown on the Site if due to the aforementioned technical reasons, since such representations are merely illustrative.
3.5 Before concluding the contract, you will be asked to confirm the reading of the General Conditions of Sale including the information on the right of withdrawal and the processing of personal data.
3.6 The contract is concluded when the Seller receives your Order Form through the Internet, subject to verification of the correctness of the data relating to your order.
3.7 The language available to conclude the contract with the Seller is Italian and the applicable law is Italian.
3.8 Once the contract is concluded, the Seller will process your order for its processing.
4. Evasion of the Order
4.1 With the transmission through the Internet of the Order, you unconditionally accept and undertake to observe, in relations with the Seller, these General Conditions of Sale.
4.2 Once the contract is concluded, the Seller will send you, by e-mail, a Confirmation of the Order, containing a summary of the information already contained in the Order described in paragraphs 3.3, 3.4 and 3.5.
4.3 It remains the possibility, on the part of the Seller, before sending the Order Confirmation, to request you via e-mail or on the phone indicated by you, further information with reference to the Order sent by you via the Internet.
4.4 The Seller may not process your purchase orders that do not give sufficient guarantees of solvency or that are incomplete or incorrect or in case of unavailability of the products. In these cases, we will inform you by e-mail that the contract is not concluded and that the Vendor has not processed your order specifying the reasons. In this case the sum previously committed to the customer's payment means will be disengaged.
4.5 If the products presented on the website are no longer available or on sale after sending the Order, it will be the Seller's responsibility to notify you promptly and in any case within thirty (30) working days from the day following the one in which you have transmitted your order to the Seller, the possible unavailability of the Products ordered. In this case the sum previously payed by the customer means will be refunded.
4.6 Each sale made by the Seller through the online sales service may concern one or more products, with no quantity limit for each item.
4.7 Randi Creazioni S.r.l. reserves the right to refuse orders from a customer with whom there is a legal dispute regarding a previous order. This applies equally to all cases in which Randi Creazioni S.r.l. considers the customer unsuitable, including, for example, the case of previous violations of contract conditions for online purchase on the Site or for any other legitimate reason, especially if the customer has been involved in fraudulent activities of any kind.
5. Sales prices
5.1 Unless otherwise specified, all prices of the Products and the shipping and delivery costs indicated on the website and in the Order are to be considered VAT included and expressed in Euro. The validity of the indicated prices is always and only the one indicated by the website when the Order is transmitted via the Internet. Product prices and shipping and delivery costs may vary without notice. Then make sure of the final sale price before submitting the relevant Order.
5.2 All products are shipped directly from Italy. The prices of the Products and the shipping and delivery costs indicated on the website and in the Order, unless otherwise specified, are to be considered not inclusive of any costs related to customs duties and related taxes if the shipment takes place in non-EU countries or in countries where the current legislation provides for import charges.
5.3 These costs are therefore charged to the Customer and must be paid directly upon delivery of the Products, according to the instructions specified in the Order Confirmation.
5.4 The customer declares that the lack of knowledge of the costs, charges, duties, taxes and/or taxes referred to in paragraph 5.2 can not constitute grounds for termination of this contract, at the time of sending an order, and that can not in any way charge the aforementioned charges to Randi Creazioni Srl.
6. Method of payment

7. Shipping and delivery of products
7.1 Each shipment contains:
- the ordered product;
- the sales receipt (for orders from Italy) / invoice (for orders from European Countries);
- return's document and label with our address in case of return;
- any accompanying documentation required according to the Country of shipment;
- informational and marketing material.
7.2 The delivery of the Products purchased through the Seller's website can take place in different ways.
7.3 Customer home delivery
7.3.1 The products purchased will be delivered by the courier identified by the Seller to the shipping address indicated by the Customer on the Order. Consult the Shipping section for additional information on costs, delivery times and methods and countries served.
7.3.2 Upon receipt of the goods at your home, we ask you to check the integrity of the packages at the time of delivery by the courier. In case of anomalies you will have to detect and note exactly the same by the courier and reject the delivery. Otherwise the possibility of asserting your rights in this regard will expire.
8. Right of withdrawal
8.1 Only if the Customer who signs the contract is a Consumer (meaning any physical person acting on the site for purposes unrelated to any business or professional activity), will have the right to withdraw from the contract concluded with the Seller, without no penalty and without specifying the reason, within fourteen (14) working days, starting from the day of receipt of the products purchased on the website.
8.2 To exercise the right of withdrawal, the customer must send to Randi Creazioni S.r.l. a communication to the e-mail address info@henryandhenryshop.com within 14 (fourteen) working days from the day of receipt of the Products, the customer can tell to the Seller the will to withdraw from the contract, indicating which Products will be returned and the reason, indicating in the return’s document the name and the number of order.
8.3 The product must be returned to Randi Creazioni S.r.l. within fourteen (14) working days from receipt of the return authorization sent by e-mail from Randi Creazioni S.r.l. together with the return’s document received.
8.4 The right of withdrawal is subject to the following conditions:
Returned Products must be returned in their entirety and not only some components of them even in the case of kits;
Returned Products must not have been used, worn, washed or damaged;
Returned Products must be returned in their original packaging, complete in all its parts (including packaging and any documentation and accessory equipment);
Returned Products must be sent to the Seller in a single shipment. The Seller reserves the right not to accept Products of the same Order returned and sent at different times;
Returned Products must be delivered to the carrier within fourteen (14) working days from the date you received the products;
in the event that the Seller, with the purchase of a specific package of Products, offers the possibility to purchase them at a lower price than what would normally be done by buying them individually (eg 5x4, 3x2 etc.), the right of withdrawal it can also be exercised by returning only some of the products purchased: in this case the price will be recalculated taking as a reference the price normally applied for the purchase of the single product. In all other cases (eg combined sales, premium transactions, etc.) the right of withdrawal can be exercised only with the return of all the Products covered by the purchase, thus excluding any partial exclusion.
8.5 If the right of withdrawal is exercised by you in accordance with the previous conditions (paragraph 8.4), the Seller is required to return the sums paid by the customer no later than 30 days from the material received by the Seller of the returned products. Normally the crediting of the amount charged to the credit card, PayPal account, by bank transfer or by a voucher of the same amount credited in the customer card (valid for the next purchase within three months), takes place very quickly, but the times on which the re-credit will actually be visible on your current account will depend on your bank. In the case of a bank transfer, the customer will promptly provide the bank details on which to obtain the reimbursement (IBAN code).
8.6 In case of return, the costs at your expense will remain the initial shipment of the order of products purchased and those of transport for the return of goods.
8.7 In case of withdrawal, to limit damage to the original packaging, we recommend, when possible, to put it in a second box (avoid in all cases the affixing of labels or adhesive tapes directly on the original packaging of the product).
8.8 The shipment, until the certificate of receipt in our warehouse is under the full responsibility of the customer. Randi Creazioni S.r.l. is not responsible in any way for damage or theft/loss of goods returned by uninsured shipments. Under no circumstances will cash-on-delivery parcels be withdrawn or assigned.
8.9 The costs incurred for collecting cash on delivery payments will not be returned to the customer.
8.7 Randi Creazioni S.r.l. will also pay the original shipping costs of the Products only in case of damage to them due to or errors in shipping by the Seller himself (not for the forwarder's errors). Only in these cases, the Seller will also refund the amount you paid as shipping costs.
8.8 For the return the Customer must use only the Courier indicated by the Seller in the Return Form delivered together with the goods sent. Subsequently, the Seller, except for the provisions of the point 8.7 and for cases of restitution due to a defect of the product, will deduct from the refund the amount of shipping and delivery to the Customer. Moreover, the Seller will be released from any liability in case of loss or damage of the products during transport.
8.9 In case of exercise of the right of withdrawal, the Seller will provide the corresponding refund within 30 days from the date of receipt of the returned Products, according to the methods indicated above, by crediting the amount to be refunded with the same payment methods chosen by the Customer at the time of the Order.
8.10 In the case of exercising the right of withdrawal without complying with the methods indicated above (eg after more than 14 days provided for by law, or without having filled in the Return Form, etc.), the Seller will re-send the purchased Products again by charging you the additional shipping costs.
8.11 The right of withdrawal can not be applied in the case of personalized products upon your explicit request at the time of insertion of the Order.
9. Warranty of non-compliant products
9.1 The Seller is responsible for any defect in the products offered on the site, including the non-compliance of the items with the products ordered, in accordance with the provisions of Italian law.
9.2 If the Customer has stipulated the contract as a Consumer (meaning any physical person acting on the site for purposes unrelated to any business or professional activity), this warranty is valid on condition that both conditions are respected indicated below:
a) the defect appears within 24 months from the date of delivery of the products;
b) the Customer presents a formal complaint regarding defects within a maximum of 2 months from the date on which the defect was acknowledged by the latter;
c) the Return Form is completed correctly.
9.3 In the event of non-compliance, the Customer will be entitled to obtain the restoration of the conformity of the products without expenses, by repair or replacement, or to obtain an appropriate price reduction or termination of the contract with respect to the disputed assets and the subsequent restitution of the price.
9.4 All return costs for defective products will be borne by the Seller.

11. Communications to the customer
The Customer acknowledges, accepts and gives his consent to the fact that all communications, notifications, attestations, information, reports and any documentation on the operations performed, referring to the purchase of the Products, will be sent to the e-mail address indicated at registration, with the possibility to download the information on a durable medium in the ways and within the limits provided by the Site.

14. Applicable law, settlement of disputes and jurisdiction
14.1 These General Conditions of Sale are governed by Italian law and will be interpreted according to it, without prejudice to any other prevailing mandatory rule of the country of habitual residence of the Customer. Consequently, the interpretation, execution and termination of the General Conditions of Sale are subject exclusively to Italian law and any disputes concerning and / or consequent to them must be resolved exclusively by the Italian jurisdiction. In particular, if the Customer holds the status of Consumer, any disputes must be resolved by the court of the place of residence or residence of the same according to the applicable law or, at the consumer's choice in case of action taken by the consumer, by the Court of Ravenna. If the customer acts instead in the exercise of his business, commercial, craft or profession, the parties consensually establish the exclusive jurisdiction of the Court of Ravenna.

17. Codes giving discount entitlement
Any discount code given is valid on all the products available on www.henryandhenryshop.com, and it will be used on a single cart and only once for each buyer and does not include shipping costs.
